THE GIVEN TERMS OF USE ARE AN ELECTRONIC CONTRACT FORMED UNDER THE INFORMATION TECHNOLOGY ACT, 2000 AND THE RULES MADE THEREUNDER AND THE AMENDED PROVISIONS PERTAINING TO ELECTRONIC DOCUMENTS / RECORDS IN VARIOUS STATUTES AS AMENDED BY THE INFORMATION TECHNOLOGY ACT, 2000. THESE TERMS OF USE DOES NOT REQUIRE ANY PHYSICAL, ELECTRONIC OR DIGITAL SIGNATURE.

These terms and conditions are governed by and construed in accordance with the laws of India and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location. These Terms of Use along with the Privacy Policy and other Agreement(s) appearing on the website from time to time sums up the entire agreement on which you (“user”) are allowed to use this website.

Additional Terms for Users

As a user of this EdTech platform, you agree to the following terms:

You must be at least 18 years old or have the consent of a parent or legal guardian to use this platform.
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device to prevent unauthorized access to your account.
You must provide accurate and complete information when creating an account or making a purchase on this platform.
You agree not to use this platform for any illegal or unauthorized purpose, and you must comply with all applicable laws and regulations.
You will not share, sell, or distribute any course materials, including but not limited to videos, quizzes, and assignments, without explicit permission from the platform or course instructors.
You will not engage in any activity that may disrupt or interfere with the proper functioning of the platform, including but not limited to using automated scripts, bots, or any other unauthorized means to access the platform or its content.
You understand that the platform may use cookies and other tracking technologies to improve user experience and collect usage data. By using the platform, you consent to the use of cookies and tracking technologies as described in our Privacy Policy.
You acknowledge that some courses on this platform may require additional software or hardware, and it is your responsibility to ensure you have access to the necessary tools to participate in the course.
We reserve the right to suspend or terminate your account and access to the platform if you violate any of the terms and conditions outlined herein.

Scope of our services

Trainity is an online virtual office where you (“user”) will experience the opportunity to build real-world products deployed on the internet. Our focus is that you learn by working on live projects with startups. We will focus on transforming you into a 2.0 version of yourself.

Intellectual Property

All content available on this platform, including but not limited to course materials, videos, text, graphics, logos, and images, are the intellectual property of the platform or its content providers and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or display any of the platform's content without prior written permission from the platform or the respective content owners.

Termination of Contract

We reserve the right to change the site, deny access to the site, application or services without any prior notice or explanation to particular users in order to protect the interest of other users or ensure that everyone remains bound to our Terms of Use. You shall remain committed to our Terms and have no right to Terminate them until the expiry of the same.

Indemnification

You agree to indemnify and hold harmless the EdTech platform, its affiliates, instructors, and partners from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the platform or any violation of these terms and conditions.

We reserve the right to modify or amend these terms and conditions without any prior notice. Your continued use of the Website after any changes shall signify your acceptance of the modified terms and conditions.

The Website may provide links to or frame third-party websites or resources and may link Users automatically to sponsors’ or third party’s websites or resources. You acknowledge and agree that Trainity is not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by Trainity of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.You should review the applicable third party’s terms and policies, including privacy and data gathering practices of any website to which you navigate

Payment

Customers agree to pay the price for the courses registered as per the pricing schedule indicated on the Site in order to avail of any of the Services offered by Us. We shall provide access to the content only after receiving the full Payment. Payment shall be made through credit/debit cards, digital wallets, or internet banking.

We use a third-party payment gateway and the relationship between the Users and third-party payment gateway shall be governed by the Terms of Use and Privacy Policy of the said payment gateway and We shall not be a party to any dispute arising therefrom. We are also not liable for any errors or delays made by the third-party payment gateway.

Notifications and Communication

You agree to Trainity sending you emails, notifications, and important messages from time to time via its websites, mobile applications, and email to provide you with a better experience with the services provided by us. You agree that we may provide notices to you on our website, or through an email sent to an email address you provided, or through other means including but not limited to your mobile number, telephone, or email. You agree to keep your contact information up to date.

When You use the Website or send emails or other data, information, or communication to Us, You agree and understand that You are communicating with Us through electronic records and You consent to receive communications via electronic records from Us periodically and as and when required. We may communicate with You by email or by such other mode of communication, electronic or otherwise.

Limitation of Liability and Disclaimer of Warranties

Trainity shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the platform or its content. The platform and its content are provided "as is" and without any warranties of any kind, whether express or implied. Trainity disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

Rules of Conduct

As a user of the Trainity platform, you agree to adhere to the following rules of conduct:

Respect other users and instructors on the platform.
Do not share, distribute, or reproduce course materials without permission.
Do not engage in any activities that may disrupt or harm the platform's functioning.
Do not violate any applicable laws or regulations while using the platform.

User Restrictions

By using the Trainity platform, you agree to the following user restrictions:

Jurisdiction and Dispute Resolution Terms

These Terms of Use shall be governed by the laws of India. Each party hereby irrevocably submits to the exclusive jurisdiction of the courts of Jaipur, India for the adjudication of any dispute hereunder or in connection herewith.

Obligations and Undertaking

You hereby agree and undertake that you are a restricted user of our website and shall not:

Provide any information which is false, fraudulent, inaccurate, misleading or incomplete or which is defamatory, libellous, unlawfully threatening or unlawfully harassing
Conduct or forward surveys, contests, pyramid schemes or chain letters
Involvement in any unauthorized use of the Website, including a collection of usernames and/or email addresses of other users by electronic or other means to send unsolicited emails, or create user accounts by automated means or under pretenses.
Create or send any viruses, worms or trojan horses, flood or mail bombs, or engage in denial of service attacks while using the Site.
Reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Website.
Use any information obtained from the Website in order to harass, abuse, or harm another person.
Use the Website in a manner inconsistent with any applicable laws or regulations.
Access the site from any means other than the platform provided by us.

Modification of Terms

Trainity reserves the right to modify or update these terms and conditions at any time. The modified terms will be effective upon posting on this page. We recommend reviewing the terms regularly to stay informed about any changes.

Effective Date for Policy

This Terms and Conditions policy is effective as of 15-01-2024. It applies to all users of the Trainity EdTech platform.

Internship & Placement Placement T&C

Trainity welcomes you. We want to lend you all of our support in making the shift to your selected domain a success.

The Trainity Course Job/Internships Opportunity is provided to you subject to the terms and conditions listed below.

We want you to share responsibility for your career transition as well. To be eligible for this assurance, you must meet the following criteria. You may still complete the course and gain all of the benefits of placement training if these standards are not satisfied, but you will not be eligible for the opportunities granted under this assurance.

Requirements for Eligibility
- You must be at least 18 years old.
- By the day you are permitted to complete the Course, you must have a Bachelor's Degree in any topic from an accredited educational institution. In addition to the essential skills and experience you will gain during this Course, most employers still require a Bachelor's degree.
- If you are still in your final or third year of your Bachelor's degree when you enrol in the Trainity Course, you must not have any detentions, backlogs, or other issues that might prevent you from working or interning once the Course is completed.
- You must be able to communicate in both oral and written English.
- After successfully finishing the Course, you must be eligible to work legally in India.
- Any background checks related to jobs/internships that you apply for must be passed. Without limiting the above, you will not be eligible for this guarantee if you are unable to get a job/internship offer due to your inability to pass a background check related to the job offer.
- Only internships will be recognised as Qualifying chances for applicants who are still in their final or third year of their Bachelor's degree at the time of enrolling in the Trainity course.
Qualifying Opportunities

Definitions
1. A salaried or waged employee who works at least 30 hours each week on average; or
2. A full-time contractor for at least three months ; or
3. An intern in a paid or unpaid internship who is being evaluated for a full-time salaried position; or
4. A freelancing job that pays part-time or full-time.
The Qualifying Opportunity that you pick, will be agreed upon between you and the Trainity team.
Guarantee Period

The "Guarantee Term" is defined as the time between the completion of your 3-month Course and the receiving of a Course certificate of completion, or a longer period if we've mutually agreed to extend it. Despite the preceding, Trainity reserves the right to prolong the Guarantee Period at its discretion:

(A) by one month in case seasonal hiring slowdowns.
or
(B) by up to six months if a natural disaster or unforeseen event occurs beyond Trainity's control.

The Trainity Guarantee is only valid in India. Trainity , on the other hand, does not promise a position in a specific city or location. Candidates must be willing to relocate for jobs or internships.
Commitment from the Candidate

To properly transition you into your Trainity course profession, we demand equal efforts and commitment from you.

Hence, in order for the Trainity Guarantee to be applicable:

You must have completed all of the graduation requirements, which include:
- You must finish 80 percent of the Course within 100 days of the commencement date of your Course, excluding any breaks granted to you by Trainity.
- You must successfully complete all of the projects in your Course.
- You must achieve or exceed expectations in all projects and tasks that have been approved by the Trainity (as per the Review criteria). You may submit revised versions depending on feedback until you satisfy expectations.
- You must complete and pass all placement training assignments that were either (a) stated in the curriculum in the order as they appear in the curriculum, or (b) directly assigned to you. This includes, but is not limited to, participating in all necessary calls and mock interviews.
After completing the aforementioned essential conditions, the 6-month guarantee term begins on the day you are approved for completion.
- You must respond to Trainity's placement-related contacts within 72 hours.
- To achieve a Qualifying Opportunity, you must constantly make reasonable and good faith attempts.
How This Guarantee Applies To You

Without limiting the preceding, situations that render this guarantee null and void include, but are not limited to :
1. You decline a job offer in exchange for a Qualifying Opportunity.
2. You decide not to search for jobs.
3. You decide to look for a job that does not satisfy the aforementioned Qualifying Opportunity requirements or is not in the Trainity field/industry.
4. You take a position that does not fulfil the above-mentioned Qualifying Opportunity requirements or is not in the Trainity field/industry before the 6-month guarantee term expires.
5. You do not want to or are unable to live and work in one of the cities with Qualifying Opportunity positions.
6. You do not interact with Trainity on a continuous basis during your search, including informing us of any offers you receive.
7. You lose your work authorization in India or do not have enough work authorization to satisfy the conditions outlined above during your search, even though you expected to have authorization or had suitable work authorization at one point during your Course.
8. During the Course or guarantee term, you become physically or psychologically unable to undertake a successful job search as indicated above.
9. Throughout the 6-month placement period, you do not apply for Qualifying Opportunities in the cities where positions are available, as specified above
10. You do not complete the interview process for Qualifying Positions in a timely and professional manner, including but not limited to not participating in the interview process as expected by the employer by responding to employer communications, showing up on time for interviews, and providing documents or following up as expected by employers.
11. You no-show or reschedule/cancel a call with a career counsellor or mock interviewer three or more times with less than 24 hours notice.
General

This Trainity Guarantee and Terms, together with the Trainity Terms of Service, constitute the complete understanding between you and Trainity about the subject matter hereof. Any unenforceable term of these Terms has no bearing on the enforcement of any other provision. Trainity has the right to evaluate whether the Terms have been met and if you are eligible for this guarantee.
